Saint Charles Research Inc., (SCR), warrants
to the original purchaser only, that each new
product is free from defects in material or
workmanship for a duration of one year from
the date of delivery. If the purchaser
discovers a failure of the new product within
the warranty period, the purchaser must
promptly notify Saint Charles Research Inc. in
writing. In no event shall such notification
be received by Saint Charles Research Inc.
later than seven months from the date of
delivery. After such notification, Saint
Charles Research Inc. will repair or replace
any faulty warranted part without charge,
provided any such parts are returned
transportation paid and, upon examination, are
found defective. Replacement parts for
Products covered by this Warranty are
warranted for the balance of the one year
period. After the warranty period, new
replacement parts are warranted for 90 days
from the date of installation of such parts.
These remedies are the purchaser's exclusive
remedies for breach of warranty.
This warranty shall not apply when the claimed
defect is due to (a) failure of purchaser to
follow Saint Charles Research Inc.
instructions and specifications including
performance of recommended maintenance, (b)
failure of normal maintenance items including
but not limited to print lamps, heat absorbing
glass and air filters, (c) failure of
purchaser to apply adequate production quality
control procedures as recommended by suppliers
of sensitized goods and chemicals, (d) changes
in characteristics or process procedures made
by suppliers of sensitized materials, (e)
alteration by the purchaser or its agent, or
(f) purchaser misuse, negligence or accident.
In no case shall Saint Charles
Research Inc. be liable for any incidental, or
consequential damages based upon breach of
warranty, breach of contract, negligence,
strict tort, or any other legal theory. Such
damages include, but are not limited to, loss
of profits, loss of use of the Saint Charles
Research Inc. product or associated parts,
cost of capital, injury to property, downtime,
the claims of third parties including
customers, and cost of any substitute
equipment, facilities or services. Some states
and countries do not allow limits on
warranties, or on remedies for breach in
certain transactions. In such states or
countries, the limits in this and the
proceeding paragraph may not apply. Any action
for breach of warranty must be commenced
within nine months from the date of delivery
of the new product.
This is the exclusive warranty. Implied
warranties of merchantability and fitness for
a particular purpose are excluded. No waiver
or modification of this warranty or any of its
terms shall bind Saint Charles Saint Charles
Research Inc. and the purchaser and such
allocating is reflected in the price of Saint
Charles Research Inc. products.
